Terms of Service

1. Acceptance of Terms

By accessing or using the Quarkloop website (“quarkloop.com”) or the Quark runtime software (“Quark”), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. What These Terms Cover

These Terms govern your use of the Quarkloop website (quarkloop.com), documentation, and any paid Quark Enterprise services. They do not govern the open-source Quark runtime, which is licensed separately under Apache 2.0.

3. Open Source vs. Commercial

Quark (the open-source runtime) is licensed under the Apache License, Version 2.0. Your use of that software is governed entirely by that license. Quark Enterprise is a commercial product that builds on the open-source core and adds enterprise features. Quark Enterprise is governed by a separate commercial license agreement provided upon purchase.

4. User Responsibilities

You are responsible for your use of Quark, including compliance with applicable laws, the configuration of LLM providers, and the content generated by AI agents running on your infrastructure. Quarkloop does not have access to, control over, or responsibility for data processed by your local Quark instances.

5. Intellectual Property

The Quarkloop name, logo, website content, and documentation are owned by Quarkloop. The Quark runtime source code is licensed under Apache 2.0. Third-party trademarks (e.g., LLM provider names) belong to their respective owners.

6. Disclaimer of Warranties

Quark is provided “as is” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the software will be error-free or uninterrupted.

7. Limitation of Liability

In no event shall Quarkloop be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use Quark or our services.

8. Quark Enterprise Services

Quark Enterprise services (SSO/LDAP integration, priority support, private deployment assistance) are governed by separate commercial agreements. Contact us at hello@quarkloop.com for details.

9. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised terms.
